Acceptance of the present general conditions of sale

The present conditions shall apply to the sale of products by Chateau Constellation SA from its on-line shop. Products are presented to the purchaser on the home page of the Chateau Constellation website. Confirmation by a web surfer of their order on the website of Chateau Constellation SA (by clicking-on the “confirm” button) implies the full and unreserved acceptance of the present general conditions of sale (GCS), in their entirety.

Protection of minors

In accordance with Article 13614 of the Penal Code, which stipulates that the sale of alcohol or other substances in quantities which are liable to endanger health to minors aged under sixteen (16) years is prohibited, the purchaser hereby confirms, by completing the order form, that they are aged sixteen or over upon the date of the order.

Alcohol abuse

Alcohol abuse is hazardous to health. Alcohol should be consumed and enjoyed in moderation.

Protection of data files

In accordance with the provisions of the Federal Law on the protection of trademarks and indications of origin (RS 232.11) of 28th August 1992, with regard to the legal protection of databases, Chateau-Constellation.ch, through the agency of Chateau Constellation SA, is the producer and owner of all or part of the databases comprising the present site. All the data featured on this site (texts, images, graphic designs, logos, icons, etc.) are protected by copyright. Chateau Constellation SA reserves the right to modify contractual conditions and conditions of use by the updating of the present publication, without prior notice. Users shall be bound by the terms of these modifications with effect from the date of said modifications.

Use of nominative information

Your personal information will never be disclosed to third parties, unless we are constrained to do so by law under exceptional circumstances. No personal data concerning yourself will be collected in the absence of explicit reference to the effect (e.g.: during the registration process). Information collected is used for statistical purposes only. You may modify the personal data included in your profile at any time. Prices

Prices indicated in the on-line shop are ex-cellar prices, expressed in Swiss Francs, including VAT and excluding carriage costs.

Discount for collection from cellar: -5%

Quantity discounts

CHF 500.00 or over, incl. taxes: 2%

CHF 1,000.00 or over, incl. taxes: 3%

CHF 1,500.00 or over, incl. taxes: 4%

To be applied in combination with the following conditions:
•Payment on delivery, in cash or by Eurocheque: 3%
•Payment on delivery/upon ordering, by credit card: no discount
•Wine tasting events & gift vouchers: no discount

Validity of prices

Modifications to the product range, prices, exchange rates or conditions. Discounts and promotions shall not be applicable in combination.

The current price replaces and supersedes all previous prices. Information on vintages can be obtained from our customer service department on the following telephone number: 027 324 43 24, or by consulting our website at: www.chateauconstellation.ch. No commitment applies in respect thereof, in the event of a change in prices or exhaustion of stocks.

Carriage costs, terms of delivery and delivery times

For carriage paid delivery in Switzerland only (incl. taxes):

1-4 bottles: CHF 12
1 case (6 bottles): CHF 14.50
2 cases (12 bottles) or more: CHF 20

Carriage paid. Free carriage shall apply to any order with a minimum ex-tax value of CHF 300. Below this value, a sum of CHF 20.00 will be invoiced as a contribution to carriage costs.

Terms of delivery and delivery times

The delivery time shall run with effect from the verification of client data by Chateau Constellation SA, in the case of delivery without prepayment, or with effect from the receipt of settlement or bank authorization, in the case of delivery with prepayment (on-line payment by bank card). We undertake home deliveries of wine throughout Switzerland within 4 working days of the date of ordering from our on-line shop, subject to the availability of products ordered. In the event of refusal of delivery, 50% of the total invoice due shall remain payable.

Payment

Full settlement for goods shall be completed at the time of ordering, either by bank card (for secure on-line payments) of the Visa or MasterCard type, or by PostFinance transaction.

Security of credit card transactions

The credit card payment module featured in our e-shop is protected by a secure SSL 128 bit link. Any of your data transmitted by our shop are protected accordingly. This protection is compliant with statutory provisions currently in force in Switzerland. You can thus complete your purchases with full security and complete confidence.

Option for withdrawal

In all cases, the client shall notify the sales department in writing (by telephone, E-mail, fax or letter) of its decision prior to the return of goods. Exceptionally, these provisions shall only to apply to product orders which have been the subject of customization or a specific request by the client at the time of ordering (special formats, customized packaging, etc.).

Applicable law and competent court

The present GCS shall be subject to the application of Swiss law. Any dispute pertaining to sales concluded under the terms of the present general conditions shall be referred to the exclusive jurisdiction of the courts of the Canton of Valais, subject to a potential referral to the Federal Court.

Rare wines

No claims shall be accepted with respect to corked wines or wines having unusual aromas. Rare wines shall include: Bordeaux Grands Crus, Marchesi Antinori, Tenuta dell’Ornellaia, Tenuta San Guido, Angelo Gaja.
